New York District Judge Alison J. Nathan ruled that Agence France-Press and The Washington Post infringed upon photojournalist Daniel Morel's copyright by their unauthorized use of his pictures from the 2010 Haiti earthquake. Morel had posted his pictures to Twitter. The Post published Morel's pictures after they had been distributed by Getty Images. The case turns on whether Twitter's terms of service gave AFP a legal right to download and re-distribute the pictures. The judge found that Twitter users retain their rights to the content they post. Read NPPA general counsel Mickey H. Osterreicher's analysis of the case in NPPA's Advocacy Blog online here.
